A policy of insurance is a very complex contract. For decades the interpretation of an insurance policy's language has been the subject of great controversy between the policyholder and the insurance company. Whether a commercial or personal policy, the language of the insurance contract is always accompanied by terms outlining the coverage available and limiting those coverage by "Exclusions," "Definitions," "Conditions," "Obligations," and other restrictive terms. The limitation of coverage created by such terms are frequently surprising to the policyholders whose expectation of coverage is usually much broader.

Florida is among a few states that allows insurance companies to perform a "second look underwriting" by permitting cancellation of a policy after a claim is presented if the insurance company determines that the policyholder made a misrepresentation on the insurance application.  Cancellation for misrepresentation on the insurance application is a very tricky subject because the policyholder is often cooperating with the insurance company after a claim, in compliance with the policy language that obligates the policyholder to cooperate as a condition for coverage.  Under these circumstances, however, the policyholder is unaware that the insurance company has hostile motives and is looking for facts that could trigger an exclusion or cancellation of the policy.
